No, by law you cannot be sacked for making an accident at work claim, unless your employer finds that you were grossly negligent in causing the accident.
If an employer sacks an employee for making a claim, they could also be sued under employment law.
No Win No Fee means that if your claim is unsuccessful, you won't have to pay us any fees.
If your claim is successful, you will pay a small percentage of your compensation amount to cover your solicitor's costs. This percentage is agreed before the claim starts.
Evidence is important when it comes to making a successful claim. Without it, the defendant may reject the case.
The more evidence you can provide your solicitor the better. However, if you're having difficulty getting hold of it, don't worry. We can help you.
To give your case the best chance of success, we recommend obtaining:
- Medical notes or letters relating to your injury
- A copy of the accident report that explains what happened
- Any photographs you have of the cause of the accident or your injuries
- Any CCTV or video footage that shows what happened
All compensation claims for injury are subject to a time limit.
From the date of the accident, you have just 3 years to make a claim. If you don't do so in this time, you may be prevented from claiming altogether.
The exception to this rule involves children under the age of 18. The time limit for them doesn't start until they turn 18, though a claim can be made before this time with the help of a litigation friend.
